Okullarda üst aramanın hukuki temelleri

Abstract

Bu çalışmada amaç, ortaokul ve liselerde yönetici ve öğretmenlerin okul ve öğrenci güvenliği için başvurdukları üst arama ve kişisel eşyalarına el koyma yönteminin hukuki temelinin olup olmadığı araştırılmıştır. Üst aramanın ulusal ve uluslararası hukuk literatüründe nasıl yer almaktadır? Sorusunun cevabı aranmıştır. Bu araştırmada nicel bir araştırma yöntemi olan tarama yöntemi uygulanmıştır. Araştırmada önce konuyla ilgili literatür taraması yapılmıştır. Araştırmada ulusal ve uluslararası düzeydeki yazılı ve basılı kaynaklar ile internet ortamında yer alan kaynaklar taranmıştır. Araştırmada tarama sonucu elde edilen veriler kaynakları gösterilerek olduğu gibi aktarılmıştır. Araştırmada elde edilen bulgular önyargıdan uzak, bilimsel veriler ışığında tartışılıp ve yorumlanmıştır. Araştırmada uluslararası hukukta kişilerin özel yaşam gizliliği ilkesinin ön planda olduğu bu bağlamda vücut dokunulmazlığı ve özel eşyalara el konulması için kanuni düzenlemeler yapılabileceği verileri bulunmuş. Ulusal hukuk ve eğitim mevzuatında kanun düzeyinde yönetici ve öğretmenlere öğrencilerin üst arama ve eşyalarına el koymayla ilgili bir düzenlemenin olmadığı tespit edilmiştir. Üst arama ve eşyalara el koyma kanunlar tarafından kolluk kuvvetlerine, hâkim kararına bağlı olarak verilen bir yetkidir. Bu yetkinin yönetmelik ve resmi yazılara dayalı olarak uygulayan yönetici ve öğretmenlerin öğrenci tarafında oluşan mağduriyet ve hukuki hak arama karşısında zor durumda kalacakları görülmektedir. Yönetici ve öğretmenlerin başvurdukları üst aram ve eşyalara el koyma uygulamasının öğrencilerin güvenliği için gerekli olduğu bu nedenle de yasal dayanak olarak kanuni düzenleme ile bu uygulamanın sınırlılıklarının çizilmesi önerilmektedir.

The aim of this study is to investigate whether there is a legal basis for the body search and confiscation of personal property for manager and teachers in secondary and high school for school and student safety. The answer of howthe body search take place in national is and international law literature has been searched. In this study, a quantitative survey method was applied. In the research, firstly the literature survey about the subject was done. In the research, national and international written and printed resources and internet resources were searched. In the study, the results of the screening were reported as shown by the sources of the data obtained. Findings obtained in the research were discussed and interpreted in the light of scientific data, away from the prejudice. In the context of the study, it was found that the principle of privacy protection of persons in international law is the front-line, and that legal regulations can be made for immunity of the body and confiscation of private property. National legislation and education legislation has established that there is no regulator of the body search and confiscation of the students by the managers and teachers at law level. Body search and confiscation are laws given by law enforcement officers, depending on the judge's decision. Administrators and teachers who apply this authority on the basis of regulations and official writings will be in a difficult situation in search of victimization and legal rights created by the student. It is recommended that the supervisor and the teachers apply the body search and confiscation seizure for the safety of the students and therefore draw the limitations of this application with the legal regulation as the legal basis.
