İmam eş-Şâfiî’nin görüşlerinin Dâvûd ez-Zâhirî’nin usûlüne etkileri

Abstract

İslam hukuk tarihinde imam eş-Şâfiî, görüşleri ve ortaya koyduğu usûlüyle kendisinden sonra gelen ekollere tesir etmiştir. Zâhiriyye mezhebinin kurucu imamı Dâvûd ez-Zâhirî de mezhebinin usûlünü inşâ ederken eş-Şâfiî’den büyük ölçüde etkilenmiştir. Bu makalede eş-Şâfiî’nin görüşlerinin Dâvûd ez-Zâhirî’nin usulündeki etki ve yansımaları tespit edilmeye çalışılmıştır. Bu bağlamda eş-Şâfiî’nin zâhirî/lafzî anlama sarılma prensibi Dâvûd ez-Zâhirî’yi de etkilemiş ve bu ilke onun usulüne büyük oranda yansımıştır. eşŞâfiî’nin haber-i vâhidin otoritesi üzerine kurduğu usûlü Dâvûd ez-Zâhirî’de de görülmüş hatta o, haber-i vâhidin kat‘î ilim ifade edeceğini iddia ederek eş-Sâfiî’nin bir adım daha ötesine geçmiştir. eş-Şâfiî’nin sükûtî icma‘ ve bölgesel icma‘ fikrine karşı çıkıp evrensel icma‘ anlayışını ileri sürmesi Dâvûd ez-Zâhirî’yi etkilemiş, onu ihtilaflı durumları dışarıda bırakan kat‘î icma‘ fikrine yönlendirmiş ve bu sebeple Dâvûd ez-Zâhirî, icma‘ı sahâbe dönemiyle sınırlandırmıştır. Dâvûd ez-Zâhirî, kıyası dışlayan usulünü oluştururken de eş-Şâfiî’nin görüşlerinden yararlanmış, onun istihsanı reddetmek için kullandığı delilleri kıyasa uygulayarak kıyas ve diğer re’ye dayalı yöntemlere başvurmadan mezhebini inşâ etmeye çalışmıştır.

In the history of Islamic law, Imam Shafii effected the following schools with his ideas and methodologies. Dawud az-Zahirî, who created Zahiriyya was inspired by Shafii when he created his methodology of his madhab as well. In this article, it has been tried to define how Shafii’s ideas effected the methodology of Dawud al-Zahirî. In this context, the principle of Shafii’s hold of the exoteric/verbal meaning effected Dawud al-Zahirî and this principle reflected on his methodologies. The methodology of Shafii, that was created on haber-i wahid’s was seen in the doctrine of Dawud al-Zahirî. He also claimed that haber-i wahid expresses exact knowledge. Shafii’s defiance of silent icma‘ (consensus) and regional icma‘ and mentioning universal icma‘ effected Dawud al-Zahiri, made him guided to the idea absolute icma‘ that excludes disbuted conditions. So, Dawud al-Zahiri restricted icma‘ with the era of sahabet. Dawud al- Zahirî benefited from Shafii’s idea when he created his methodology that excluded qiyas and put his proofs that he used to reject istihsan into practice without qiyas; briefly he created his madhab without qiyas and other methodologies based on re’y.
