İslâm hukuku açısından Afganistan’da zina suçu ve cezası

Abstract

Gerek yerel Afganistan gerek dünya ve gerekse Türkiye basınında, ayrıca sosyal medyada, Afganistan ülke sınırları içerisinde zina fiiline yönelik olarak uygulanan recm cezaları popüler bir tartışma konusuna dönüşmüştür. Bu yüzden zina fiiline yönelik olarak tatbik edilen Afganistan uygulamalarının ele alınması önem arz etmektedir. Nüfusunun geneli Müslümanlardan oluşan bir İslâm ülkesi olan Afganistan’da çıkarılan kanunlar, Hanefî metinleri temel alınarak hazırlanmaktadır. Dolayısıyla Afganistan sınırları içerisinde zina fiiline uygulanan cezaların, düzenlenen kanunlara ve Hanefî fıkhına uygunluğu ve ne şekilde uygulandığı oldukça mühimdir. Çalışma, Afganistan devleti sınırları içerisinde zina cezasına yönelik uygulamaların bir bütünlük ve sistem içerisinde olup olmadığı, farklı uygulamalar var ise bu uygulamaların kanunî dayanağı, kaynağı ve kanunların hazırlanma süreçleri üzerinde durmaktadır. Dolayısıyla bu tez Afganistan’da uygulanan recm cezalarının, devlet otoritesinin güçlü olduğu bölgeler ile zayıf olduğu bölgelerde nasıl, ne şekilde ve hangi kriterlere göre uygulandığını ve bu uygulamanın Afganistan'da genel kabul görmüş Hanefî mezhebinin ilkeleri ile mukayesesini içermektedir.

The punishment of stoning for adultery within the borders of Afghanistan has become a popular topic of discussion in the local Afghan, International and Turkish press, as well as in the social media. Therefore, it is important to address the practices of Afghanistan which are applied to the act of adultery. The laws enacted in Afghanistan which is an Islamic country with a predominantly Muslim population, are prepared on the basis of Hanafi school. Therefore, it is very important that the punishments applied to the act of adultery within the borders of Afghanistan comply with the laws and Hanafi fiqh and how they are applied. The study focuses on whether the practices for adultery within the borders of the Afghan state are in integrity and system, and if there are different practices, what are the legal basis, source and preparation process of the laws. Therefore, this thesis covers how, in what way and according to what criteria the stoning punishment applied in Afghanistan are applied in regions where the state authority is strong and in regions where the state authority is weak, and the comparison of these practices with the principles of the Hanafi school, which is generally accepted in Afghanistan.
