İslam hukuku ve medeni hukukta boşanma süreçlerinin manevi destek ve rehberlik bağlamında karşılaştırılması

Abstract

İnsan yaratılış özelliği olarak hem maddi hem de manevi yönü bulunan bir varlıktır. Bu yüzden insan hayatı da tek boyutlu ele alınamaz. Boşanma da evlilik gibi insan hayatında bulunan bir olgudur. Boşanma olgusunu ele alırken insanın her iki yönüne de hassasiyetle yaklaşılmalıdır. İslam Hukuku ve Medeni Hukuk boşanma olgusuna insanın hem maddi hem de manevi yönünü dikkate alarak çözümler getirmiştir. Bu çalışma boşanma süreçlerine getirilen çözümleri Manevi Destek ve Rehberlik yönünden incelemeye yoğunlaşmıştır.

Man is a creature that has both material and spiritual aspects as a feature of creation. Therefore, human life cannot be considered one-dimensional. Divorce, like marriage, is a phenomenon in human life. When dealing with the phenomenon of divorce, both aspects of the human being should be approached sensitively. Islamic Law and Civil Law have brought solutions to the phenomenon of divorce by taking into account both the material and spiritual aspects of human beings. This study focuses on examining the solutions to divorce processes in terms of Moral Support and Guidance.
