Adli olay belgelerine ilişkin uzman raporlarında yazı ve imza inceleme yaklaşımlarına yönelik görünümler

Abstract

“Adli Olay Belgelerine İlişkin Uzman Raporlarında Yazı ve İmza İnceleme Yaklaşımlarına Yönelik Görünümler” başlıklı bu araştırmanın amacı, adli olay belgelerine ilişkin uzman raporlarında yazı ve imza inceleme yaklaşımların ve çözümleme araçların belirlenmesidir. Bu çalışmada nitel araştırma yöntemlerinden doküman incelemesi kullanılmıştır. Araştırmanın örneklemini amaçlı örnekleme yöntemi ile seçilen, çalışma amacına uygun 19 adli belge incelemesine ilişkin uzman raporu oluşturmuştur. Uzman raporlarında çoklu incelemeler yapıldığı görülmüş, çözümleme alanları yazı sahteciliği, imza sahteciliği, düzmece belge, belgede değişiklik alanlarında ayrı ayrı değerlendirilmiştir. Yapılan çözümleme sonucunda adli belge incelemelerinde uzmanların, imza sahteciliğine yönelik imza inceleme deney yöntemi (kaligrafik yöntem), yazı sahteciliğine yönelik el yazısı inceleme deney yöntemi (grafolojik yöntem), düzmece belgeye yönelik belge inceleme deney yöntemi (filigran yöntem), belgede değişiklik incelemelerine yönelik belge, el yazısı ve imza inceleme yöntemi kullandığı görülmüştür. Uzmanların imza sahteciliğine yönelik yapılan incelemelerde çözümleme aracı olarak büyüteç ve stereo mikroskop, yazı sahteciliğine yönelik çözümlemelerde belge inceleme aygıtı ve mikroskop, düzmece belge çözümlemelerinde belge inceleme aygıtı, stereo mikroskop ve morötesi ışık kaynağı çözümleme aracı kullandığı görülmüştür. Öte yandan, belgede değişiklik incelemelerinde uzmanların büyüteç, stereo mikroskop, belge inceleme aygıtı ve morötesi ışık kaynağı çözümleme aracı kullandığı belirlenmiştir. Uzmanların imza sahteciliğine yönelik yaptıkları 15 belge çözümlemesinde 7 belgede yer alan imzaların şüpheliye ilişkin olduğu, yazı sahteciliğine yönelik yaptıkları 14 belge çözümlemesinde 4 belgede yer alan yazıların şüpheliye ilişkin olduğu, düzmece belgeye yönelik yaptıkları 5 belge çözümlemesinde 3 belgenin düzmece olduğu, belgede değişiklik incelemelerine yönelik çözümledikleri 3 belgenin de değiştirilmiş olduğu sonucuna ulaştıkları görülmüştür. Uzmanların imza sahteciliğine yönelik yaptıkları 15 belge çözümlemesinde 4 belgede yer alan imzanın şüpheliye ilişkin olmadığı, yazı sahteciliğine yönelik yaptıkları 14 belge çözümlemesinde 6 belgede yer alan yazıların şüpheliye ilişkin olmadığı sonucuna ulaştıkları görülmüştür. Uzmanların imza sahteciliğine yönelik yaptıkları 15 belge çözümlemesinde 4 belgede yer alan imzalara ilişkin herhangi bir kanı oluşmadığı, yazı sahteciliğine yönelik yaptıkları 14 belge çözümlemesinde 4 belgede yer alan yazıların yazarlarına ilişkin herhangi bir kanı oluşmadığı, düzmece belgeye yönelik yaptıkları 5 belge çözümlemesinde 2 belgeye ilişkin de herhangi bir kanı oluşmadığı sonucuna ulaştıkları görülmüştür. Uzmanların belgede yer alan yazı ve imza ile şüpheliye ilişkin el yazısı ve imza karşılaştırmalarını huzurda alınan ya da samimi karşılaştırma örnekleri ile yaptığı görülmüştür. Yapılan çözümleme sonucunda adli belge incelemelerinin en az 3 uzman tarafından yapıldığı görülmüştür. Uzmanların belge incelemelerini deneyimlerine dayalı gözle ve laboratuvarda mercekli araç ve aygıt yardımı ile yaptığı belirlenmiştir. Uzman raporları belge inceleme yaklaşımlarını ve yöntemlerini, kullanılan çözümleme araçlarını, oluşan kanıyı ve varılan kanının gerekçelerini içermektedir. Uzman raporlarında yapılan incelemenin türü, kullanılan gereç, karşılaştırma örnekleri, uzmanların adları, sanları, imzalarına da yer verildiği görülmüştür.

“Views on Writing and Signature Review Approaches in Expert Reports on Forensic Documents” in this research The aim of this research is to determine writing and signature review approaches and analysis tools in expert reports on forensic event documents. In this study, document analysis which is one of the qualitative research methods is used. The sample of the study consisted of expert reports on 19 forensic documents which were selected by purposive sampling method. In expert reports, it was seen that multiple examinations were conducted and analysis areas were evaluated separately in the areas of forgery of writing, forgery of signatures, falsified documents and changes in documents. As a result of the analysis, experts in forensic document analysis, signature examination test method for signature forgery (calligraphic method), handwriting examination test method for writing forgery (graphological method), document examination test method for fake document (watermark method), document for change examination in document , handwriting and signature review methods. It was seen that the experts used magnifying glass and stereo microscope as the analysis tool for signature forgery, document examination device and microscope for the analysis of writing forgery, document examination device, stereo microscope and ultraviolet light source analysis tool for the analysis of fake documents. On the other hand, it was determined that experts used magnifying glass, stereo microscope, document inspection device and ultraviolet light source analysis tool in document change reviews. Experts’ sign the forgery in 15 documents for the signature of the 7 documents are related to the suspects, the forgery of 14 documents made for the four documents in the analysis of the documents related to the suspect, the fake document for the analysis of 5 documents in the document is a fake solution analysis. It was found that all 3 documents were changed. It was seen that the signatures in the 4 documents were not related to the suspect in the analysis of 15 documents made by the experts for signature forgery, and that the documents in the 6 documents were not related to the suspect in the analysis of 14 documents for the forgery of documents. In the analysis of 15 documents for the forgery of signature by experts, there is no opinion about the signatures in the 4 documents, in 14 documents for the forgery of the documents, in the analysis of the documents in the 4 documents, there is no opinion about the authors of the documents; an idea did not occur. It was seen that the experts made the comparisons between the letters and signatures in the document and the handwriting and signatures of the suspect with the samples obtained in the presence of peace or sincere comparison. As a result of the analysis, it was seen that forensic document reviews were conducted by at least 3 experts. It was determined that the experts conducted document inspections based on their experience with the help of a magnifying glass and microscope in the laboratory. Expert reports include document review approaches and methods, the analysis tools used the resulting opinion and the reasons for the conclusion. In the expert reports, it was seen that the type of examination, the materials used, comparison examples, the names of the experts, the people, the signatures of the experts were included.
