Konkordato

Abstract

Konkordato, borçlu işletmelere tanınan hukuki geçici koruma bicimdir. Kendine özgü şartları ve özelliklerinden dolayı hem borçlu hem de alacaklı açısından sağlıklı uygulanması yönünde dikkat edilmesi gereken hususlar içermektedir. Konkordatonun sunmuş olduğu imkânlardan gerektiği kadar yararlanan borçlunun, belirlenen zaman dilimlerinde ticari bütünlüğünü korunarak yaşam mücadelesinin devamı açısından sağlanmış olunan faydalar bulunmaktadır. Bu hukuki geçici koruma şekli olan konkordatonun borçlu ve alacaklı yönünden, istihdam ve ülke ekonomisi açısından kazanımları projede araştırılmış ve anlatılmaya çalışılmıştır.

Concordatum is the legal temporary protection granted to the debtor companies. Due to its specific conditions and features, it should be considered that both the borrower and the creditor are to be applied in a healthy way. The beneficiary, who benefited from the facilities of the concordant as much as possible, has the benefits provided for the continuation of the life struggle while maintaining the commercial integrity in the determined periods of time. This legal form of temporary protection has been researched and explained for both the borrower and creditor in terms of employment and the country's economy in terms of gains in this project.
