Türkiye’de 7101 sayılı Konkordato Kurumu ve Konkordato’nun ekonomik etkileri

Abstract

Türk hukuk sistemine 1929 yılında giren Konkordato, 1932, 1965 ve 2018 yıllarında köklü değişikliklere uğramıştır. Son olarak İflasın ertelenmesi kurumunun sadece borçlu ve mahkeme arasında yürütülmesi sebebi ile, 7101 sayılı Kanun ile alacaklılara da söz hakkı tanınması ve sürecin içerisine dahil edilmeleri amacı ile Konkordato kurumu işlevsel hale getirilmiştir. 7101 sayılı Kanun ile borçlarını ödeme güçlüğü içersinde olan veya nakit akış dengesi bozulan, borçlarını ödeme konusunda iyi niyetli olarak ticari faaliyetine devam etmek isteyen borçluları korumak ve alacaklı olanların da alacaklarını korumak amacı ile işlevsel hale getirilmeye çalışılmıştır. Konkordato kurumu ile ülkemiz ekonomisine üreterek katkı sağlayan ticari işletmelerin, faaliyetlerin devamı ülke ekonomisi ve istihdam açısından önemlidir. Bu proje ödevimin amacı, 7101 sayılı Kanun ile uygulamaya konulan Konkordato müessesinin ekonomik etkileri incelenecektir. Konkordato kurumunda karşılaşılan sorunları ele alıp, çözüm önerileri sunmaktır.

The aim of this project is to examine the economic effects of the Concordat Institution, which is implemented by Law No 7101. The aim of this course is to deal with the problems encountered in the concordat institution and to offer solutions.
