Montesquieu ve Tocqueville’in sınırlı iktidar anlayışları üzerine bir inceleme

Abstract

Montesquieu ve Tocqueville, siyasal düşüncenin merkezi konumunda yer alan iktidarı sınırlandırma düşüncesinin modern dönemdeki önemli temsilcileri olarak kabul edilmektedir. Bu çalışmada, iki düşünürün kuramlarında iktidarın sınırlandırılması bağlamında oluşturdukları fikirleri incelenip karşılaştırılmıştır. Öncelikle iktidarı sınırlandırma amacı doğrultusunda iki düşünürü de etkileyen tarihsel süreç ve kavramsal zemin incelenmiştir. Böylece iki düşünürün iktidarın sınırlandırılmasına hangi çerçeve içinde yaklaştığı, varsayımlarının benzerlik ve farklılarının neler olduğu ortaya konmak istenmiştir. Tarihsel süreç, Montesquieu ve Tocqueville’in yaşadıkları dönemlere karşılık geldiği için, Fransa’daki hemen Devrim öncesi ve sonrası süreçlere odaklanılmıştır. Kavramsal çerçeve kısmında ise, demokrasi ve liberalizm kavramları ayrı ayrı ele alındıktan sonra iki kavramın ilişkisi birlikte değerlendirilmiştir. Ayrıca merkezileşme, özgürlük ve eşitlik kavramları da iktidarın sınırlandırılması açısından kavramsal çerçevede incelenmiştir. Yapılan karşılaştırma neticesinde iki düşünürün de kuramlarında iktidarın sınırlandırılmasına dair ortaklığın liberalizmin ekseninde oluştuğu saptanmıştır. Ayrıca inceleme sonucunda iki düşünürün de iktidarı sınırlandırmak adına öne sürdükleri kavramsal ve kuramsal mekanizmalar konusunda benzerliklerinin yanında farklılıkların da olduğu ortaya konmuştur. İki düşünürün de iktidarı sınırlandırmada kuvvetler ayrılığı anlayışını savunmuşlar ve ara mekanizmaları kurgulamışlardır. Fakat ara mekanizmaların neler olacağı konusunda farklılaşmışlardır.

Montesquieu and Tocqueville are accepted as the important representatives of the idea of limiting power, which is at the center of political thought, in the modern period. In this study, the ideas of the two thinkers in the context of the limitation of power in their theories were examined and compared. First of all, the historical process and conceptual ground that affected both thinkers were examined in line with the aim of limiting the power. Thus, it was aimed to reveal the framework in which the two thinkers approached the limitation of power, and what the similarities and differences of their assumptions were. Since the historical process corresponds to the periods in which Montesquieu and Tocqueville lived, the focus was immediately on the pre-revolutionary and post-revolutionary processes in France. In the conceptual framework part, after the concepts of democracy and liberalism were discussed separately, the relationship between the two concepts was evaluated together. In addition, the concepts of centralization, freedom and equality are also examined in the conceptual framework in terms of the limitation of power. As a result of the comparison, it was determined that the partnership regarding the limitation of power in the theories of both thinkers was formed on the axis of liberalism. In addition, as a result of the examination, it has been revealed that there are similarities as well as differences in the conceptual and theoretical mechanisms that both thinkers put forward in order to limit the power. Both thinkers defended the understanding of separation of powers in limiting the power and constructed intermediate mechanisms. But they differed on what the intermediate mechanisms would be.
